We do not believe in having multiple pages of Terms and Conditions that you will never get round to reading. Whilst you should read the full Terms and Conditions, these are the basics that you are agreeing to when you access the Where Can I Find A Home (WCIFAH) web site.

Vendors

Your contract is with WCIFAH.

WCIFAH works in partnership with associates. Associates refer clients to us. WCIFAH then provide the estate agency service to the vendor. The associate has no responsibility to the vendor nor contractual relationship regarding the sale of the vendor’s property but an associate commits to using their best efforts to follow up interest shown by prospective buyers and communicating with the vendor as to the outcome of that follow up. Associates are not agents of WCIFAH and cannot commit WCIFAH to any agreement. WCIFAH do not take any responsibility for any services associates may provide.


What you receive in your package.

The details of the services you receive are outlined here (link to pricing)

YOU WILL NOT BE CHARGED A COMMISSION WHEN YOUR PROPERTY SELLS.

If you do not require all the services within a package, you won’t be entitled to a refund. Anything you request that is not included in the package, such as a Home Report or EPC will be charged for. We will provide you with a quote before you commit to any additional service.


Honesty and transparency

We will be honest and transparent in our dealings with you. We are looking to have a property portal that can be trusted so you should be honest and transparent when providing details of your property. For instance, we may receive introducers’ fees for introducing you to a third party service. These fees will be restricted to a maximum of £100 to ensure the charges for these third party services remain competitive


What to be aware of as a Buyer

Whilst we try to verify information provided on the site, you should not take any action based on the information provided. WCIFAH cannot provide warranties or guarantees whether express or implied, written or verbal regarding the information provided. You should seek professional advice before taking any action in respect of a property.


We expect you to be courteous and polite in your dealings with WCIFAH vendors. We reserve the right to bar you from the site if we find that this is not the case. Be nice.


General

You must be over 18 to use the WCIFAH site


Copyright

WCIFAH owns the copy right for all content on the site. You should not in any respect use materials we have provided within our package without our permission.

We don’t have any control over web sites to which we might have links. So we can’t take responsibility for the content on a web site to which we have a link.

  • We will only share your details if you give us permission, which can be given verbally.
  • Occasionally, we may need to send you service-related emails about your account, and we reserve the right to do so.

What you agree to as a Buyer

Our Agreement with You as a Vendor

By using our services, you confirm that:

  • a. Good Faith: You're entering this agreement honestly and genuinely want us to help sell your property.
  • b. Ownership: You're the sole or joint owner of the property, or you have the legal right to sell it.
  • c. Authority: You have the necessary permission from all owners to list the property with us, and can provide proof if needed.
  • d. Content Rights: You own or have the right to use any content you upload to our site, and it doesn’t infringe on anyone else’s rights.
  • e. Cooperation: You’ll cooperate with any reasonable security checks or information requests from us or your Local WCIFAH Associate.
  • f. Legal Status: You’ll inform us if you’re not the legal owner or if you're acting on behalf of a company or trust.
  • g. Multiple Listings: You can list your property with other agencies at the same time. If this breaches another agent’s contract, you can stop our listing with 48 hours’ written notice, but you’ll cover any costs we’ve incurred.
  • h. Information: You’ll provide us and your Local WCIFAH Associate with necessary information and materials, including a Home Buyers Report if in Scotland, to help us sell your property.
  • i. EPC: You’ll arrange an Energy Performance Certificate (EPC) before marketing if one doesn’t already exist. If it does, you’ll provide a copy within ten business days of agreeing to these terms.
  • j. Compliance: You authorize us to market the property for all co-owners and agree to provide necessary documents for Money Laundering Regulations 2017 compliance. If we can’t verify your identity, we can terminate the agreement without liability. We may use a third-party for these checks, which will incur a non-refundable fee.   • k. Connected Parties: We’ll let you know if anyone connected to WCIFAH makes an offer on your property. You must inform us if you are connected to WCIFAH, and we’ll note this on your property advert.


Content and Copyright

All material you post on our website remains the property of Where Can I Find A Home Ltd (WCIFAH). By submitting content to our website ("Content"), you give us a worldwide, royalty-free, permanent, and transferable license to use, reproduce, display, sell, modify, and edit your Content. You also waive any moral rights you might have in the Content.


We won’t pay you for your Content and reserve the right to remove or edit it at any time. You confirm that you have the necessary rights to grant us these permissions.
